The planning application DM/23/01723/RM for the erection of 38 dwellings at Kays Hall Farm, The Green, Evenwood, DL14 9QR has been APPROVED. Objectors, including the Parish Council, have multiple times raised concerns over the impact of the proposed access on the Village Green, a non-designated heritage asset (NDHA) considering this to suffer major harm. They consider the committee's report associated with the outline application to have been inadequate, including concerns that it failed to adequately describe its historic, aesthetic, and social importance or to assess its value with others in the County. However, planners consider that the harm to its significance would be limited, due to the extensive Village Green that would remain unaltered. Part of the Village Green would be lost through the construction of an upgraded road junction and access to the east of the site, to Raby Street and Evenwood Lane but, whilst the development would have an impact upon the Village Green, the harm is considered by planners to be limited. It should be noted that there is a separate statutory process to the controls of the planning system that the developer would need to go through to deregister the relevant parcel of land with Village Green status. The Church Commissioners for England (landowner) have already confirmed that they "will not be objection to the section 16 application [under the Commons Act 2006] due to the fact that the application provides compensatory village green land, and the planning application appears to be satisfactory. We recognise that the final decision lies with the planning inspectorate and if they are supportive of the development, we will not create any barrier for the development coming forward".
